Big City Realty Inc., Brokerage (“Big City Realty,” “we,” “us,” or “our”) is committed to protecting the privacy of the personal information of our clients, prospective clients, and website visitors. This policy explains what personal information we collect, why we collect it, how we use and share it, and the rights you have over it. It applies to information we collect through bigcityrealty.ca, through any forms or sign-ups on the site, and through our day-to-day brokerage and property-management services.

We handle personal information in accordance with the federal Personal Information Protection and Electronic Documents Act (PIPEDA), Canada’s Anti-Spam Legislation (CASL), the Real Estate Council of Ontario (RECO) requirements under the Trust in Real Estate Services Act, 2002 (TRESA), and the Canadian Real Estate Association (CREA) Privacy Code.

What personal information we collect

Depending on how you interact with us, we may collect:

  • Contact information you provide through a form, email, phone call, or in person – name, email address, telephone number, postal address.
  • Property and transaction information – the type of property you are looking for or selling, neighbourhoods, budget, timeline, and similar preferences; for active clients and tenants, identification, financial qualification, and transaction documents required under TRESA and RECO rules.
  • Tenant due-diligence information (for BCR Property Management applicants) – credit reports, employment and income verification, references, and identification documents, collected with your consent on the rental application.
  • Account information – if you create an MLS search account or save listings, we collect the credentials and preferences you provide.
  • Automatically collected information – IP address, browser and device type, referring URL, pages viewed, and similar analytics data collected through cookies and similar technologies.

Why we collect it

  • To respond to your inquiry and provide the real-estate or property-management service you have requested.
  • To carry out a real-estate transaction in which you are a party – including communicating with the co-operating brokerage, lawyers, lenders, and the MLS®.
  • To send you property listings, market updates, and other communications you have consented to receive.
  • To verify the identity and creditworthiness of rental applicants for our property-management clients.
  • To improve our website, marketing, and services through analytics.
  • To meet our regulatory obligations under TRESA, FINTRAC where applicable, and other applicable law.

Who we share it with

We share personal information only as needed to provide the services above. In particular, we may share with:

  • Co-operating brokerages and their agents on a transaction in which you are a party.
  • The Toronto Regional Real Estate Board (TRREB) and the Canadian Real Estate Association (CREA) through the Multiple Listing Service (MLS®) where required to list, lease, or sell a property.
  • Lawyers, lenders, mortgage brokers, and home inspectors involved in your transaction.
  • Landlord clients of BCR Property Management – only the information necessary to evaluate a rental application or administer a tenancy.
  • Service providers under contract – including our customer-relationship-management system, email-marketing platform, website host, cloud-document storage, and web-analytics providers. These providers are bound by contract to handle personal information consistent with this policy.
  • Regulators, including RECO, where required by law.

We do not sell personal information.

Marketing emails and text messages (CASL)

We send marketing communications only with your express or implied consent under CASL. Every marketing email identifies Big City Realty Inc., Brokerage and our office address, and includes a one-click unsubscribe. You can also opt out by emailing [sales@bigcityrealty.ca at any time. SMS marketing, where used, includes a STOP keyword to opt out.

Cookies and analytics

Our website uses cookies and similar technologies to operate the site, remember your preferences, and measure how the site is used. The categories of cookies we use are:

  • Strictly-necessary cookies – required for the site to function.
  • Analytics cookies – including Google Tag Manager and Google Analytics, which help us understand how visitors use the site.
  • Meta Pixel, LinkedIn Insight Tag, Google Ads conversion tracking.

You can refuse or delete cookies through your browser settings, and you can opt out of Google Analytics at tools.google.com/dlpage/gaoptout.

How long we keep your information

  • Leads and inquiries from the website – kept for 7 years from the last contact, then deleted or anonymized.
  • Transactional records – kept for at least the minimum period required by TRESA, RECO, and the Income Tax Act (typically 6 years from the end of the transaction).
  • Tenant due-diligence records – kept for 6 years following the end of the tenancy.
  • Marketing-list contacts – kept until you withdraw consent.

Your rights

Subject to legal exceptions, you have the right to:

  • Access the personal information we hold about you.
  • Request correction of personal information that is inaccurate or incomplete.
  • Withdraw your consent to certain uses, including marketing communications.
  • File a complaint about how we handle your personal information.

To exercise any of these rights, contact our Privacy Officer at sales@bigcityrealty.ca. If you are not satisfied with our response, you may also contact the Office of the Privacy Commissioner of Canada (priv.gc.ca).

How we protect your information

We protect personal information through reasonable physical, organizational, and technical safeguards. These include HTTPS encryption on our website, password-protected access to our systems, role-based access limits within Big City Realty, and contracts with our service providers that require them to handle personal information appropriately.

Data breaches

If a breach of security safeguards involving your personal information creates a real risk of significant harm, we will notify you and, where required, the Office of the Privacy Commissioner of Canada, in accordance with PIPEDA s. 10.1.

Where your information is processed

Some of our service providers – including HubSpot (our customer relationship management platform) and Mailchimp (our email-marketing platform) – are located in the United States. Where personal information is processed outside Canada, it may be subject to the laws of that jurisdiction.

Children

Our website is not directed at children under 13 and we do not knowingly collect personal information from children.

Changes to this policy

We may update this policy from time to time. The current version will always be posted on this page and the “Last updated” date at the top will be revised.
